Which States Could Legalize Recreational Weed Next
The short list for the next round of adult-use legalization is Pennsylvania, Florida, New Hampshire, Hawaii, and Wisconsin. Each one already permits medical cannabis, has an active legalization bill or campaign, and has at least one branch of government pushing the issue. No state has a locked-in date, and every projection below depends on a vote, a committee hearing, or a governor's signature that has not happened yet.

States with no medical program and no citizen initiative process, such as Idaho, Kansas, and South Carolina, sit further back. They need a legislature to act on its own, which has been the slower path in nearly every state that has legalized so far.
How a State Moves From Medical to Adult Use
Two paths dominate.
- Voter initiative. Citizens gather signatures, the measure goes on the ballot, and it passes with a simple majority in most states. Florida is the exception: constitutional amendments there need 60 percent support.
- Legislative bill. A representative or senator files a bill, it clears both chambers, and the governor signs it. This is the only path in Pennsylvania, New Hampshire, Wisconsin, and Hawaii, none of which allow statewide initiatives.
Whichever path applies, the state then writes rules for licensing, testing, taxes, and retail sales. Store openings often trail the effective date by 12 to 24 months.

Pennsylvania
Adult-use bills have cleared the state House in recent sessions and stalled in the Senate. Pennsylvania has a medical program and a governor who backs legalization, but no initiative process. Movement depends on Senate leadership.
Florida
A 2024 amendment won a majority of votes and fell short of the 60 percent required for constitutional changes. Supporters can return in a later cycle, which keeps Florida on the list.
New Hampshire
Legalization bills have passed the legislature in some sessions and met a veto. The state has no initiative process and no sales tax, so tax design drives much of the debate.
Hawaii
The Senate has advanced adult-use bills that later stalled in the House. Hawaii already has medical dispensaries in operation, which shortens the retail build-out once a law passes.
Wisconsin
The governor has proposed adult-use legalization in budget plans, and Republican leaders have countered with medical-only proposals. With no initiative process, the legislature must act.
Second-Tier States to Track
Indiana, Iowa, Kansas, North Carolina, South Carolina, Tennessee, and Wyoming appear in most forecasts. Most of these states have limited or no medical access, and several have legislatures that have blocked even medical bills. A governor change or a strong market next door can shift the math.
