The grey area is converted products. Delta-8 THC, HHC, and similar compounds are often made by chemically altering CBD pulled from hemp. It also cuts the other way. Marijuana plants are not THC-only. Some cultivars carry meaningful CBD, and plenty of people use high-THC flower for the CBD and terpenes as much as for the THC.

What to check before you buy

Look at the certificate of analysis, not the label marketing. I want to see delta-9 THC, THCA, total THC, the other cannabinoids, and whether the numbers are reported by dry weight. A product that lists only "hemp extract" tells you almost nothing about dose. The effects you get depend on how much THC is in each serving and how it is balanced against CBD, CBG, and the terpenes in the mix. The plant name on the jar is the least useful part of the decision.
